1 Plaintiff in Error, Gerald L. Brewer, hereinafter referred to as defendant, was charged in the District Court of Murray County with the crime of Murder. He was tried by a jury, and convicted of the included offense of Manslaughter First Degree, and sentenced to 17 years in the penitentiary.
